1. BOOKINGS – SCUBA DIVING IN MALTA

1.1 All participants engaging in scuba diving activities with OK Diving Malta must present a valid certification issued by PADI or another internationally recognized diving organization (e.g., SSI, CMAS, NAUI), preferably one that is recognized by the World Recreational Scuba Training Council (WRSTC). In the absence of a physical certification card, OK Diving Malta reserves the right to verify credentials through official online verification or confirmation from the certifying body.

1.2 Each participant is required to complete and sign the following documentation prior to any in-water activity:

  • International Liability Waiver and Assumption of Risk Agreement
  • Medical Declaration Form

1.3 These documents are legally binding and must be submitted before participation. Failure to comply may result in cancellation of services without refund.

1.4 Dive site selection is made exclusively by OK Diving Malta’s Dive Director, based on weather conditions, diver experience level, safety considerations, and logistics. The center reserves the right to change the dive plan without prior notice.

1.5 Minimum Age Requirement: Participants must be at least 10 years old for entry-level courses and guided dives. Minors under 18 require written parental/legal guardian consent.

1.6 Alcohol and Drug Policy: To ensure safety, all participants must not be under the influence of alcohol or drugs. OK Diving Malta reserves the right to refuse service without refund if impairment is suspected.

1.7 Equipment Responsibility: Clients are responsible for the careful and correct use of any rental equipment. Damages or loss beyond normal use may incur additional charges.

1.8 Media Consent: By participating in our activities, clients authorize OK Diving Malta to use photos or videos taken during the activity for marketing or educational purposes. If you prefer not to appear, you must notify us in writing before the dive.

1.9 Delays and No-Show
A maximum waiting time of fifteen (15) minutes will be granted from the agreed starting time of the activity. After this period, if the participant has not arrived, the activity will begin without them and no refund of the deposit paid will be issued.


2.  REQUIREMENTS TO DIVE IN MALTA

2.1 Divers must complete a Medical Declaration Form before engaging in any activity. The form helps identify if a medical certificate is required and can be accessed online at https://okdivingmalta.com/en/medical-form.

2.2 Participants answering “Yes” to any health condition must submit a valid medical certificate, issued within the last 12 months.

2.3 Failure to present a required certificate will result in service denial without refund.

2.4 Compliance with Diving Standards

All participants agree to follow at all times the internationally recognised scuba diving standards and safe diving practices established by the training agency under which the activity or course is conducted (including but not limited to PADI, SSI, or other recognised agencies).

It is the diver’s responsibility to remain within the limits of their training, certification, and experience level, and to comply with depth limits, the buddy system, ascent rates, and any other safety requirements specified by the relevant training organisation and the instructor in charge.

By participating in any diving activity with OK Diving Malta, the customer acknowledges and accepts that failure to follow these standards and practices is done at their own risk, and releases OK Diving Malta, its staff, and its instructors from any liability arising from such actions.


3. PAYMENTS – DIVING COURSE BOOKINGS MALTA

3.1 A deposit is required to confirm your booking. The amount will be communicated at the time of reservation and will be deducted from the total fee.

3.2 The remaining balance must be paid in full on the first day of diving.

3.3 Non-payment of the balance may lead to cancellation without deposit refund.


4. SUPPLEMENTS – ADDITIONAL SERVICES

Supplements related to activities such as boat dives, trips to Gozo or Comino, night dives, equipment rental, or other special services are mandatory and must be paid if the client participates in those activities, regardless of whether they were explicitly requested during the initial booking.

The choice of dive site (shore, boat, or island) is determined by the dive director on the day of the activity, based on sea conditions, group level, and overall logistics. By confirming the booking, the client accepts these terms and the possibility of incurring additional charges based on the activity ultimately provided.


5. CANCELLATIONS & REFUNDS – SCUBA BOOKINGS IN MALTA

5.1 OK Diving Malta reserves the right to cancel or reschedule activities due to unsafe conditions, technical failure, insufficient participants, or force majeure. In such cases, you may:

  • Reschedule your activity without cost
  • Receive a full refund for the cancelled service

5.2 For client-initiated cancellations:

  • More than 7 days prior: Full refund, minus any transaction fees
  • Less than 7 days: Deposit is non-refundable
  • No-shows or same-day cancellations: No refund
  • Course deposits are non-refundable, as you will retain access to the theory and certification, and can complete the practical part later or at another dive center
  • Once the activity has started, no refunds—either full or partial—will be issued, regardless of the reason for cancellation, interruption, or incomplete participation.

5.3 All cancellations or changes must be sent in writing to info@okdivingmalta.com


6. INSURANCE & LIABILITY – DIVING SAFETY IN MALTA

6.1 OK Diving Malta maintains valid insurance for students enrolled in its courses, complying with Maltese law.

6.2 Certified divers are strongly advised to purchase personal diving insurance that covers their planned activities.

6.3 OK Diving Malta and its team shall not be held liable for any:

  • Injury, illness, or death
  • Theft or loss of property
  • Incidents caused by third-party providers or unforeseen events

6.4 Divers accept full responsibility for their physical condition and the inherent risks of diving. Signing our forms signifies acknowledgment and acceptance of these risks.


7. DATA PROTECTION & PRIVACY – GDPR COMPLIANCE MALTA

7.1 We process all data in line with:

  • The Data Protection Act (Chapter 586, Laws of Malta)
  • EU GDPR Regulation 2016/679

7.2 Personal data is:

  • Lawfully and transparently processed
  • Collected for legitimate purposes only
  • Retained for 5 years, as required by law

7.3 Clients may exercise their rights to:

  • Access, correct, or delete data
  • Restrict or object to processing
  • Request data portability
